TourScale and its family of brands — including Trolley Pub, Pedal Pub, Paddle Pub, Tiki Pub, and Cruisin' Tikis (collectively "Company," "we," "us," or "our") — are committed to protecting the privacy of visitors to our websites, customers of our franchise locations, and users of our TourStaff operator platform. This Privacy Policy describes how we collect, use, disclose, and safeguard your information.

Information We Collect

We collect information you provide directly to us when you inquire about franchise opportunities, book a tour through one of our franchise locations, or otherwise interact with our websites and services. This may include your name, email address, mobile phone number, postal/ZIP code, country, and any other booking details you or the operator submit on your behalf (such as guest count and special-occasion notes). We may also collect certain information automatically when you visit our websites, including your IP address, browser type, operating system, referring URLs, and information about how you interact with our sites.

How We Use Your Information

We use the information we collect to fulfill your tour booking, send transactional communications (including payment links and tour reminders), respond to inquiries, provide customer support, improve our websites and services, and comply with applicable law. With your consent, we may also use your mobile number to send transactional SMS messages related to your booking. We may use aggregated, de-identified data for analytics to better understand how visitors use our platform.

SMS / Text Communications

TourScale operates the TourStaff operator platform used by our franchise locations to manage bookings. With your explicit consent, we may send you transactional SMS messages about your booking through this platform — for example, payment links, booking confirmations, and tour reminders. We also separately offer optional SMS notifications related to franchise inquiries.

Consent. You provide consent to receive SMS in one of two ways: (1) by checking a clearly labeled, not-pre-selected opt-in checkbox on the operator's booking form when your phone number is collected at booking time, or (2) by verbally agreeing when an operator confirms the opt-in over the phone for phone-in bookings. The operator's booking form discloses message purpose, frequency, applicable rates, and links to this Privacy Policy and our Terms of Service. You may also opt in by texting START to any program from which you have previously opted out.

Message frequency. Up to four (4) messages per booking. Total volume varies based on how many tours you book.

Message and data rates may apply. Standard carrier message and data rates may apply to messages you receive from us. Check with your mobile carrier for details.

Opt-out. You may opt out at any time by replying STOP to any message you receive from us. After you reply STOP, we will send a final confirmation message and will not send you further SMS messages unless you opt back in.

Help. Reply HELP to any message for assistance, or contact us at support@tourscale.com.

Carrier liability. Carriers are not liable for delayed or undelivered messages.

Non-sharing of mobile information. No mobile information (including phone numbers) or SMS opt-in data will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subprocessors is limited to what is strictly necessary to deliver the requested service (for example, our SMS gateway provider delivers the message on our behalf and may not use the number for any other purpose). This restriction applies to all categories of mobile information collected through this site or any TourStaff-powered booking flow.

Cookies & Tracking Technologies

Our website uses only essential cookies required for the site to function properly. We do not use advertising cookies, retargeting pixels, or third-party analytics tracking. You may control the use of cookies through your browser settings, though disabling cookies may affect certain features of our website.

Third-Party Service Providers

We share information with trusted service providers only to the extent necessary to deliver our services. These subprocessors include: (a) Twilio (SMS delivery), (b) Amazon Web Services / Amazon Simple Email Service (email delivery and infrastructure), (c) Peek Pro (booking management software used by our franchise locations), and (d) Stripe (payment processing). Each subprocessor is contractually obligated to handle your information only for the purpose of delivering the service we have engaged them for. We do not sell your personal information, and we do not share mobile phone numbers or SMS opt-in data with any third party for marketing purposes.

Data Security

We implement commercially reasonable security measures to protect personal information submitted to us, including TLS encryption in transit, encrypted storage at rest, and access controls on our internal systems. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security of your data.

Data Retention

We retain personal information only as long as needed to provide our services, comply with our legal obligations, resolve disputes, and enforce our agreements. Booking records (including the customer's name, contact information, and tour details) are retained for as long as the franchise location uses the TourStaff platform plus a reasonable archival period for accounting and tax compliance. You may request earlier deletion as described under "Your Rights" below.

Your Rights

Depending on your location, you may have rights regarding your personal information, including the right to access, correct, port, or delete your data, and the right to opt out of certain processing. You may opt out of receiving SMS by replying STOP, and out of marketing email by following the unsubscribe instructions in our messages. To exercise any other right, contact us at support@tourscale.com. We will respond within the timeframes required by applicable law (typically 30–45 days).

Children Under 13

Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this page. Material changes will be communicated in advance where reasonably practical.
